J.B.D.L. Corp. v. Wyeth-Ayerst Laboratories (Premarin)
This anti-trust class action was filed by pharmacies and other drug purchasers against Wyeth-Ayerst to redress violations of federal antitrust laws, including price fixing. The suit claims that Wyeth-Ayerst, a dominant pharmaceutical manufacturer, entered into exclusive and secret contracts with pharmacy benefits managers and managed care organizations in order to control the marketplace with respect to the drug Premarin. Plaintiffs claim that the contracts served as exclusive dealing arrangements for Premarin thereby preventing the managed care industry and their drug formularies from competitively offering alternative drugs.
